for registering housing society, giving conveyance deed
All these are not allowed to do is to make buyers of houses
builders and developers Construction professionals (builders) are required to
live for one to five years,
1) Not giving possession of house for the period of
construction,
2) Not giving "CC" & "OC"
(Completion Certificate and Occupation Certificate) for giving possession,
3) Not getting approved map of the building,
4) Not getting the registration done,
5) Not getting the buyer to buy the house 6) Not depositing
the amount in the bank account,
7) Not carrying out construction as per plan,
8) Not constructing a house or building more than the
prescribed amount,
9) Not setting up a cooperative housing society within four
months of purchasing the 60% land,
7) Not carrying out conveyance within four months of setting
up a society,
Such acts are in violation of section 11 of the Maharashtra
Flat Ownership Act 1963 (MOFA). This offence is punishable with three years
education under Section 13(1). This offence is serious and intrusive. I have
the right to inform the police society, take the criminal cases to court,
to make the consumers aware and give the police orders to
register the cases against builders and developers construction professionals,
such request was accepted by the All India Consumer
Panchayat to the State Director Generals of Police in April. All the
interferences in Babi are sinful.
Many common people are afraid of builders and developers and
do not complain about it. In such circumstances, the police has issued a
circular to the state's Special Inspector General of Police, Prabhat Kumar,
regarding registration of offence under Section 11/13(1) of the Maharashtra
Flat Ownership Act 1963 (MOFA) against the land owner and the builder who are
suo motu complainants on behalf of the government. If police intervenes in the
matter, you can file a personal complaint in the court (as per section 156(3)
of CrPC). Court can give police order to lodge an offence under the court
order.
What is conveyance deed?
It means that the land on which a building is constructed is
the property of the society.
The land on which the name of my society is conveyed is the
entire land of the society. All the flat holders of mine have the right over it
(no change is made by the builder in this matter).
But which land is owned by the society?
What is conveyance deed? Then the land is owned by the
society's nodal officer (I own all the flat holders)
If conveyance deed is not done then what will happen?
For some reason in future, if the members of the building
are not given any rights then the owner of the land is not entitled to it.
If the building is old and needs redevelopment then it
cannot be redeveloped without the permission of the land owner.
If the building is to be redeveloped then only the builders
and developers will get the higher FSI.
(I have got a house in double the area of your original
area but the land is owned by the society otherwise the builder would have
taken the advantage and hence I am the owner of the land). Now many flat
holders have such a misconception that conveyance deed cannot be done,
similarly builders and developers - builder will redevelop you,
▪️ will give you flat of double
area.
▪️ Rent will be paid until the new
construction is completed.
▪️ Give corpus fund to the society.
Redevelopment: Many people are misunderstood as they want to
get a double flat for free from builders and developers. But the question of
who is the builder and how will he do it never comes to people's mind.
Will any builder ever be ready for redevelopment?
You don't have to spend crores of rupees to sell the land,
that is just money, you are talking about the expenditure of buying and doing
crores of rupees. In the redevelopment process, the builder should consider the
cost of land development and NA construction cost. So if the money is to be
recovered and some profit is made then no builder is considering redevelopment.
But people do not understand this hope that after thirty-forty years, when you
have become the owner of your own house and have come to your house, you again
have to spend money on it. But if someone becomes the new generation of society
then who else would give them the house of? Your heart started to feel like
giving you a share of the land ownership.
After examining the cost of land, construction cost, legal
process, management, publicity charges, administrative fees and maintenance of
goons, business competition, profit/risk potential, what will the builder give
to the old flat holders or what will the offer be made by them.
As far as people are concerned, conveyance was not done by
your builders and developers - the builder will give you a double flat. Asha
people are fond of builder, this is the aim and I am careful about such people.
If there is a dispute over the existence of such Lok Samithi then the whole
society is being cheated and it is very important to make the people aware
about it, for the next four to five years, if the work is not done as per the
bylaws and the cases are filed arbitrarily, then the same builders and
developers - the builder's real people are in front of us. Ashi people are
continuously moving forward, they are doing progress, they organize programs at
a fast pace, people have faith in them, but Ashi people are moving forward,
they are doing progress for the people
In the same year, the flat holders are being kept in the
dark regarding society membership, share certificate, society registration,
conveyance deed etc. and in a way they are blackmailing the people but the aim
of the flat holders is to achieve the same and it has been achieved late.
Hey, all this is to be done for the sake of such people,
conveyance deed of such people should be done, perhaps such people will have to
face financial problems. In the beginning five to ten years of your life, in
the society, all kinds of disputes were being raised,
in the society, the issue of Shevat's Majuli, lift, many
such questions were being raised and till then the Barechhan house was left
vacant, you did the conveyance and it was forgotten by the people that your
society is a society indistinguishable. Just don't do that! I cannot believe
anything except the papers,
And you are the one who has awakened from the house of yours
only!
